Five Chinese Held for Illegal Property Brokering in Pattaya

PATTAYA — Tourist Police have arrested five Chinese nationals and one stateless person for illegally operating as real estate brokers without permits in Bang Lamung District, Chonburi Province.

Police Lieutenant General Saksira Phuek-am, Commander of the Tourist Police Bureau, led officers with a search warrant to inspect an unnamed real estate office opposite The Chill shopping mall on Boon Samphan Road, Nong Prue subdistrict, Bang Lamung district on December 16. Officers found six individuals, including five Chinese nationals and one stateless person, working as brokers selling and renting properties through online channels to Chinese clients.

During the investigation, authorities discovered that some properties handled by the suspects had previously been used as bases for call center scam operations that were busted earlier. The suspects confessed to earning commissions from property sales and successful deal closures.

The suspects have been charged with working without permits under the Foreign Workers Management Emergency Decree B.E. 2560 and illegal entry into the Kingdom under the Immigration Act B.E. 2522. They were taken to Nong Prue Police Station for legal proceedings.

This operation is part of the Tourist Police Bureau’s intensive crackdown on foreigners working or residing illegally in Thailand, particularly in areas with high concentrations of foreign residents and significant business districts.

Myanmar Jails 4 Thai Fishermen as Tensions Rise Over Maritime Incident

RANONG/BANGKOK — Myanmar’s Kawthaung Provincial Court has sentenced four Thai fishermen, aged 61-69, for illegal entry, despite the incident taking place in waters disputed by Thailand and Myanmar.

A boat owner has received 5 years in prison, for illegal fishing in Myanmar waters without permission, and an additional 1 year for illegal entry into the country, totaling 6 years imprisonment, along with a fine of 200,000 Kyat (approximately 3,400 Baht, $95).

The three Thai crew members were each sentenced to 3 years in prison for illegal fishing in Myanmar waters without permission, and an additional 1 year for illegal entry into the country, totaling 4 years imprisonment each, with fines of 30,000 Kyat (approximately 510 Baht, $14) per person.

However, the Kawthaung Provincial Court showed mercy to all 4 Thai fishing crew members after the fishing boat captain confessed to fishing for mackerel in Myanmar waters. The prison sentence was suspended, and to maintain good international relations, all 4 Thai crew members will be released back to Thailand during the upcoming New Year 2025 festive holiday.

Meanwhile, 27 Myanmar crew members were sentenced by the court to 1 year imprisonment each on charges of illegal entry into the country.

The incident, in which Myanmar warships opened fire on Thai trawler fishing vessels on the night of November 30, resulted in the death of one Thai fisherman and injuries to several others. In addition, a Thai fishing boat named “Sor. Charoenchai 8” along with its 31 crew members (4 Thai and 27 Myanmar nationals) was seized by Myanmar forces and towed to Koh Yan Chueak in Myanmar territory.

Two weeks later, the Thai authorities have still not secured the return of the crew and the Sor. Charoenchai 8 to Thai territory. The Thai government’s diplomatic efforts to release the crew and vessel “unconditionally” through the Thai-Myanmar Border Committee (TBC), which the Thai government has repeatedly emphasized, have caused concern.

However, this appears to be “almost impossible” as Myanmar representatives on the TBC have informed their Thai counterparts that the release process is entirely dependent on orders from Naypyidaw.

12 Nautical Miles Off Koh Phayam

The Thai Purse Seine Association, of which the Sor. Charoenchai 8 is a member, reported in detail on the events of November 30. According to the report, Thai fishing boats were fired upon by Myanmar warships while fishing 12 nautical miles off Koh Phayam.

The Myanmar warships did not fire warning shots, but opened fire with the intention of damaging lives and property. The main targets of the attacks were the ship’s bridge and control tower. One crew member of the Thai vessel Duang Thaweepol 333 was killed in the shooting, and Myanmar forces detained another Thai vessel, the Sor. Charoenchai 8, along with its 31 crew members. The captured vessel was towed into Myanmar waters near Koh Yan Chueak.

When the Thai TBC representative in Ranong learned of the incident, he sent a letter to his counterpart in Kawthaung to inform him that at 12:20 p.m., three armed warships from Myanmar approached a group of Thai fishing boats as they were setting their nets in Thai waters, 12 nautical miles west of Koh Phayam, at approximately latitude 9°45’N and longitude 98°17’E. The Myanmar warships opened fire, causing casualties and injuries, and detained the Sor. Charoenchai 8.

The TBC in Ranong sees this action as a serious violation of Thai sovereignty and a threat to national security. It claims that the action violates the agreements governing the overlapping territories between the two countries. The Thai side has demanded the return of the crew and the vessel.

The Ranong Fisheries Bureau, acting on behalf of the Ranong Maritime National Interest Protection Center, issued an immediate notice on November 30 to warn fishermen and fishing operators to “exercise caution for their safety when operating near the Thai-Myanmar maritime border.”

As a result, the area 12 nautical miles off Koh Phayam, an “overlap zone” claimed by both Thailand and Myanmar, has become a danger zone for Thai vessels. Myanmar has asserted its claim by deploying armed warships to the area, making it a high-risk zone where Thai vessels must navigate with caution for safety reasons.

Historical Context of Overlapping Zones

Since the November 30 incident in which armed Myanmar warships fired on Thai fishing boats, no Thai authority has clarified the status of the area 12 nautical miles west of Koh Phayam (9°45’N, 98°17’E) where Thai fishing boats were operating. The documents on the Thai-Myanmar border disputes point to three important issues:

1) Shared Maritime Boundaries

Thailand and Myanmar share maritime borders that begin at the tri-border area between Thailand, India and Myanmar, extend north of the Surin Islands and reach as far as Koh Khom and the Paknam Kra Buri estuary, a distance of 195 nautical miles. To date, Thailand and Myanmar have agreed on 140 nautical miles of the border, from the triangle point to the northern part of North Surin Island. However, the remaining borders are still unresolved, resulting in overlapping sea areas.

2) Boundary Disputes Near Koh Khom

Disputes over boundaries between North Surin Island and Koh Khom span 50 nautical miles and involve claims over three islands: Koh Lam (approximately 150 square kilometers), Koh Kan, and Koh Khi Nok. The disputed boundary also extends to the waterways adjacent to these islands and the Paknam Kra Buri estuary.

3) Undefined Maritime Boundaries

From North Surin Island to Koh Khom, neither Thailand nor Myanmar has officially declared its maritime border. Myanmar uses British Admiralty charts 3052 and 216, which support its claims, while Thailand relies on charts 307 and 331. The lack of declared boundaries leads to confusion and overlapping claims, making fishing and navigation difficult.

Sovereignty Claims Over the Three Islands

In addition to the unresolved maritime borders, both Thailand and Myanmar have claimed sovereignty over Koh Lam, Koh Kan and Koh Khi Nok since the border negotiations between Siam and the British colonial authorities in 1867–1868. During the negotiations, ownership could not be clarified, so the maritime boundary remained undefined.

Historical records show that Sir John Lawrence, Governor-General of India, proposed that Koh Chang and Koh Phayam should belong to Siam, while Koh Victoria, Koh St. Matthew and the Bird’s Nest Islands should belong to Britain. However, Koh Lam, Koh Kan and Koh Khi Nok were not mentioned in this proposal, leaving their status unresolved.

Recent discussions suggest that high-level negotiations between the Thai and Myanmar governments should focus on defining the remaining maritime boundaries in the Andaman Sea, excluding the three islands. A median line could serve as a provisional maritime boundary allowing navigation and fishing under international law and by mutual agreement.

Final Warning

The lack of clear maritime boundaries makes naval operations aimed at safeguarding national maritime interests more difficult. The incident with the Sor. Charoenchai 8 illustrates these challenges. According to Article 15 of the 1982 United Nations Convention on the Law of the Sea, in cases where neighboring coastal states (such as Thailand and Myanmar) do not have an agreed maritime boundary, a median line can serve as a provisional boundary.

Thailand has drawn a centerline from North Surin Island to the vicinity of Koh Lam, Koh Kan and Koh Khi Nok as an operational guideline for vessels in the area. The presence of the Thai fleet in overlapping zones at the time of Sor. Charoenchai 8 raises the question of whether Thai ships crossed the maritime boundary.

Before the Myanmar warships opened fire, Thai ships had received a warning from the Vessel Monitoring System (VMS), which is controlled by the FMC Center: “Thai ships are approaching the waters of the neighboring country. Please proceed with caution.”

For the First Time in 8 Years, a US Navy Ship Makes a Port Call in Cambodia

SIHANOUKVILLE, Cambodia (AP) — A U.S. Navy warship arrived Monday in Cambodia, the first such visit in eight years to a nation that is China’s close ally in Southeast Asia. Cambodia’s government has suggested the port call reflects an upgrade in often-strained relations.

The USS Savannah docked at the port of Sihanoukville on the Gulf of Thailand for a five-day visit. The Savannah, classed as a Littoral Combat Ship, carries a crew of 103.

“It’s great to be back, returning U.S. presence to here after eight years,” the ship’s commanding officer, Daniel A. Sledz, said in brief remarks to reporters. He was given a bouquet of flowers by a Cambodian officer and shook hands with a line of her colleagues.

The United States for many years has had rocky relations with Cambodia, criticizing its government for political repression and human rights violations. There is particular concern about its close ties with China, which Washington fears may get exclusive access to a Cambodian naval base on the Gulf of Thailand, not far from where the Savannah docked.

Recently, there seem to have been moves to patch up relations.

Cambodia’s Ministry of National Defense said last week that the visit was scheduled after a U.S. request for a port call, and would “strengthen and expand the bonds of friendship as well as promote bilateral cooperation” between the two nations.

Two days before that, Cambodia’s foreign ministry noted “positive momentum of bilateral ties and cooperation” and “the reinvigoration of military-to-military cooperation” between Cambodia and the U.S.

U.S. Secretary of Defense Lloyd Austin visited Cambodia in early June, where he held talks with Prime Minister Hun Manet and other senior officials. He also met with Cambodian alumni of U.S. military training programs. Hun Manet himself is a graduate of the U.S. Military Academy at West Point.

The U.S. Defense Department said at the time that Austin’s discussions concerned “opportunities to strengthen the U.S.-Cambodia bilateral defense relationship in support of regional peace and security,” and other matters.

But Washington remains concerned that the upgrading of Cambodia’s Ream Naval Base near Sihanoukville will serve Beijing’s strategic interests in the region.

The U.S. and others suggest China’s navy is establishing a permanent base at Ream, which would give it easier access to the Malacca Strait, a critical shipping route between the South China Sea and the Indian Ocean.

Controversy over the Chinese activity at Ream initially arose in 2019 when The Wall Street Journal reported that an early draft of an agreement seen by U.S. officials would allow China 30-year use of the base, where it would be able to post military personnel, store weapons and berth warships.

Cambodia’s government has denied such an agreement or any intention to grant China special privileges at the base, though Beijing has funded its expansion.

In September, Cambodia’s Defense Ministry said that China is giving its navy two warships of the type it has had docked there for months. China is set to hand over two newly built Type 56 corvettes — smaller vessels typically used for coastal patrols — next year at the earliest, after Cambodia requested China’s support.

Cambodia’s defense ministry said the Savannah’s port call will include “a working meeting with the commander of the Ream Naval Base,” as well as meetings with provincial officials and “a friendship sports competition between the crews of the U.S. Navy and the Cambodian Navy.”

Cambodian Navy Capt. Mean Savoeun, deputy commander of the Ream Naval Base, was among those dockside welcoming the Savannah to Sihanoukville. He said he was happy to see the good relationship between Cambodia and the U.S., especially their navies, and believed the visit will bring closer diplomatic cooperation.

“I have agreed to appoint Thaksin as my personal advisor as chairman of ASEAN,” Anwar stated, noting that Thaksin would be supported by a team comprising members from various ASEAN nations in an informal capacity. Addressing Prime Minister Paetongtarn, who is Thaksin’s youngest daughter, Anwar expressed gratitude for the arrangement, citing the value of experienced statesmen.

The meeting between the two prime ministers proved productive, with both leaders signing key agreements to strengthen bilateral ties. They established an ambitious trade target of US$30 billion by 2027 and signed two Memorandums of Understanding – one focusing on rubber industry development and economic cooperation, and another on cultural heritage collaboration.

During their discussions, both leaders addressed pressing regional issues, including recurring floods along the border areas, particularly near Sungai Golok. They agreed to work on long-term solutions and improve infrastructure connectivity to facilitate trade and strengthen people-to-people relations.

Thaksin’s appointment comes after his recent return to public life in Thailand. The former prime minister, who led Thailand from 2001 to 2006 before being ousted in a military coup, spent 15 years in self-imposed exile. He returned to Thailand in August 2023 and, after serving six months of a reduced one-year sentence, was released on parole in February 2024.

Prime Minister Paetongtarn emphasized that her visit aimed to reinforce the importance of Thai-Malaysian relations and expand collaboration between the two nations. The meeting concluded with an invitation for Anwar to visit Thailand in the near future, underlining the commitment to regular diplomatic engagement between the neighboring countries.

Swiss Man in Tears After Violent Teen Gang Attack in Pattaya

A tearful Mr. Kamai, a 66-year-old Swiss national, filed a police report at Pattaya City Police Station on Dec. 15, 2024 after being assaulted by a group of teenagers who also vandalized his car.

PATTAYA — Mr. Kamai, a 66-year-old Swiss national, broke down in tears while filing a police report at Pattaya City Police Station late last night after being assaulted by a group of teenagers who also vandalized his car.

The victim appeared at the station at 11:30 p.m. with visible injuries to his face, including a swollen left eye, head injuries, and multiple abrasions.

According to Mr. Kamai’s statement, translated through a language application, the incident occurred on South Pattaya Road near a local school. After finishing his meal, he returned to his parked car to find 4-6 teenagers surrounding it. The group began smashing his Toyota Vios’ windows with rocks.

When he attempted to intervene, two assailants attacked him, knocking him to the ground. Despite his pleas for mercy, the teenagers continued to kick and beat him until passersby interrupted the attack, causing the group to flee.

Police Lieutenant Sutheeraphan Thapsri documented the victim’s injuries and examined the damaged vehicle, which sustained broken front and rear windows.

Investigators have been dispatched to review CCTV footage and gather witness statements in the area. A police radio alert has been issued with the suspects’ descriptions, though no arrests have been made yet.

Bangkok, Thailand – December 12, 2024 – The Four Seasons Hotel Bangkok at Chaophraya River played host to the Dot Property Southeast Asia Awards 2024, a grand celebration honoring the region’s most exceptional property developers, projects and agencies.  Recognised as one of Southeast Asia’s most prestigious awards programs, the event has become a cornerstone for real estate professionals across the region. 

Over 350 guests were treated to an evening of opulence and entertainment, highlighted by captivating musical performances that added a touch of glamor to the festivities, including a mini concert performed by special guest Thai artist K. Burin Boonvisut.  The pinnacle of the evening was a magnificent riverside fireworks show by the Chaophraya river, illuminating the Bangkok skyline.

Big winners on the night included the Philippines’ RLC Residences who were awarded Developer of  the Year title recognising their continued leadership in the Philippines property sector and the prestigious gala brought together key players, influencers, and visionaries in the real estate sector, offering a platform to honor and applaud the outstanding achievements of developers and agencies who have shaped the landscape of Southeast Asia’s real estate market.
