Legal Conflict Over Luxury Villas Demolition on Koh Samui

KOH SAMUI — Thai authorities have encountered more obstacles this week in enforcing administrative action to demolish a luxury villa project on Koh Samui, Surat Thani Province.

Koh Samui Municipality, the Internal Security Operations Command (ISOC) Region 4, and the Ombudsman’s Office could not enforce administrative action as the project’s lawyers obstructed them on October 21, and some villas remained occupied by residents.

On that day, the lawyer presented himself to the officials and informed them that they had filed a petition to revoke and oppose the order with the municipality on October 18, therefore requesting officials not to proceed with the demolition.

On October 23, officials from the Koh Samui District Administration, Bo Phut Police Station, ISOC Region 4, and the Ombudsman’s Office attempted another enforcement at the Ariya Residence project in Moo 3, Maret Subdistrict, Koh Samui District.

Meanwhile Nanthawat Charoenwan, deputy director of ISOC in Surat Thani, sent an urgent letter to the mayor of Koh Samui on behalf of the regional ISOC director. The letter instructed the municipality, as the local authority, to take administrative action to enforce compliance with the Building Control Act, particularly Articles 42 and 43, without the need for court approval under Article 43(1). The instruction required demolition to begin no later than 10:00 a.m. on October 22, 2024.

The operation included the use of crowbars and sledgehammers to open the gates of the project for inspection. Officials surveyed the 11 villas to determine the approach, budget and technical methods for demolition.

However, some villas were still occupied, the residents had locked the doors and refused to cooperate. The officials tried to negotiate with the residents through the locked doors, explaining the reasons for the demolition and asking them to leave the houses. Those who refused were warned of possible legal consequences. The police cordoned off the area with tape and signs indicating that it was a demolition zone with restricted access.

Pal-lop Meepian explained that the demolition is being carried out on the basis of administrative law and that the site is officially designated as a demolition area. On October 25, evidence will be presented to Bo Phut police to take legal action against anyone obstructing officers in their work.

He also clarified that although the project’s 11 villas, seven of which were licensed, had received building permits, the buildings were constructed in violation of the law. The municipality had previously issued orders to stop construction and restrict occupancy, but the owners of the project neither complied nor appealed the orders. As a result, final demolition orders were issued in 2019 and 2024, making the villas illegal under the Building Control Act.

The authorities stated that on October 25 they would sue the lawyers for obstructing officials in the performance of their duty and would present evidence to Bo Phut Police Station for legal action.

The Internal Security Operations Command Region 4 has been conducting inspections and taking action since June after receiving complaints about construction on steep terrain in Koh Samui, Surat Thani Province, which violates environmental and building control laws. Some properties were also operating as unlicensed hotels.

Local sources revealed that Chinese investors had leased land for 30 years from Thai companies to build villas for sale to foreigners and rent them out nightly through an online vacation rental company without proper hotel registration. This affects tourism and legal hotel businesses, and results in lost tax revenue.

Experts from various fields also provided insights and attracted a large audience.

Dr. Surakiart Sathirathai, President of the Council of Chulalongkorn University and former Foreign Minister and Deputy PM, delivered a keynote address examining how different scenarios would unfold if either Donald Trump or Kamala Harris wins the election.

He said that some people have expressed the opinion that if Donald Trump wins and returns to office, the world will face upheaval, but US politics will be stable. On the other hand, they believe Kamala Harris would have the opposite effect.

However, in his own opinion, regardless of who wins, global instability is inevitable. The difference is that with Harris, the situation might be more predictable, whereas with Trump, the uncertainty would be harder to anticipate because Trump is a negotiator, and his decisions would depend on negotiation outcomes

The World Will Remain Turbulent

He believes that no matter who wins the election, the US approach towards the Alternative International Economic Order, which could potentially reduce US power – such as the expansion of BRICS and reducing dependence on the dollar – will face similar opposition.

Regarding political issues, he thinks the US is unlikely to change much in terms of international conflicts, and the world will remain turbulent. Although Thailand is not a conflicting party, the country has been severely affected economically.

“In some conflicts, we have the capability to act as a bridge, but we shouldn’t try to bridge matters where we lack influence. For instance, in the Russia-Ukraine conflict or Middle East issues, we don’t have the power to mediate. However, we can bridge conflicts where we do have some influence, such as in Myanmar’s case and humanitarian assistance. Thailand must take a leading role in these matters,” he said.

In his closing remarks, Dr. Surakiart concluded as he began his keynote, stating that regardless of who wins, global turbulence will continue. The difference lies in whether this turbulence will be predictable or unpredictable. Therefore, Thailand must carefully monitor the signals and conduct future foresight.

Key Points on Trump’s Policies: Tax Cuts

In the second seminar session, Pravit Rojanaphruk, senior reporter from Khaosod English, moderated a discussion between two speakers: Professor Dr. Siriphan Noksuan Sawaddee from the Faculty of Political Science at Chulalongkorn University, who analyzed Trump’s campaign policies, and Phil Robertson, former Deputy Asia Director at Human Rights Watch, who summarized key Democratic Party policies.

Professor Dr. Siriphan noted that Donald Trump, representing the Republican Party, appeals to voters by strengthening the “power of the purse” through tax cuts. In Trump’s first term, the corporate tax rate was reduced from 35 percent to 21 percent. If re-elected, Trump wants to lower it further to 15 percent, while Kamala Harris wants to raise it to 28 percent.

When it comes to immigration control, Trump’s tough immigration policy suits supporters of the “America First” ideology, who emphasize the need to protect American jobs and prevent crime. The Biden administration saw a record number of immigrants enter the country in 2023, with over 300,000 legal and illegal entries, while the numbers were lower under Trump.

Trump also intends to reshape global trade rules by raising tariffs on imports from all countries by 10-20 percent, with a 60 percent tariff on Chinese goods. This is in contrast to the current average tariffs of 3 percent. Trump’s trade policy, initiated in 2018, treats China as a strategic threat, a stance that is likely to continue under any future US administration, including Biden or Harris.

Key Points on Harris’s Policies: Human Rights Focus

Analyzing Kamala Harris’s policies, Phil Robertson highlighted her emphasis on human rights in domestic and foreign affairs, including abortion rights. He predicted she would take a stand against products made under exploitative labor conditions.

In contrast to Trump’s tariff-centric approach, Harris favors negotiations with China and promotes domestic production in order to survive global competition.

Harris also disagrees with Trump’s stance on NATO and Ukraine. While Trump proposes reducing NATO support and allowing Russia’s control over Ukraine, Harris would likely uphold U.S. commitments to European allies.

It is expected that both candidates will pursue similar strategies in Asia to contain China’s influence while securing economic interests.

Thailand’s Positioning: Strategic Balance Needed

The following discussion session has the topic: ‘How does the American election affect Thailand?

Associate Professor Dr. Jittiphon Poonkham from Thammasat University’s Faculty of Political Science pointed out that both Trump and Biden aim to maintain U.S. global leadership, build democratic alliances, and counter China’s growing influence.

Dr. Jittiphon notes that Thailand has been only nominally allied with the US and has had minimal substantive cooperation compared to other key US allies such as Japan or South Korea. Under Biden, the US has pursued a “friend-shoring” strategy, i.e. it has established production facilities exclusively in allied countries. Thailand was not included in this framework.

So the crucial question for Thailand is whether it can become part of the US friendshoring network and what steps it needs to take to achieve this status.

Dr. Jittiphon suggests that Thailand should consider whether US national interests are aligned with its own. Thailand must choose its alliances based on where its interests lie, but base its actions on international principles to maintain an honorable and respectable position on the global stage.

Support for “Multi-Directional Diplomacy”

Assistant Professor Dr. Prapeer Apichartskul from the Faculty of Social Sciences at Srinakharinwirot University emphasized that Kamala Harris’s human rights policy is likely to continue Biden’s approach of integrating democracy and human rights into US foreign policy.

The implications for Thailand could be that US-Thailand relations will again be tied to human rights, which could lead to sanctions or the suspension of certain privileges. To avoid such repercussions, Thailand must demonstrate its commitment to human rights in order to improve its international standing and promote global acceptance.

During Trump’s presidency, Thailand was faced with the revocation of the Generalized System of Preferences (GSP), which was attributed to human trafficking and intellectual property violations. Should Trump return to power, similar unpredictable measures could be repeated.

In terms of foreign policy, Dr. Prapeer commended the previous Thai government for navigating difficult situations where a choice of direction was inevitable. He noted that not only Thailand but also other ASEAN countries are under pressure to choose sides between the major powers. However, if Trump wins, ASEAN countries will likely face more pressure than in a scenario with Harris as president.

Recommendations on Trade and Investment

Panithan Paworolarnvithaya, deputy secretary general of the Federation of Thai Industries (FTI), emphasized that both Trump and Harris prioritize their countries’ economic and trade interests. Therefore, Thailand must plan and prepare to adapt to possible global economic changes, regardless of who wins the US election.

Once the United States elects its president, trade wars, geopolitical tensions, currency wars, and how the U.S. views China as a national threat are the issues to watch and monitor. As a result, there is a possibility that more Chinese goods will flow into Thailand as it will become more difficult to export to the US.

However, it is suggested that Thailand should not take a clear-cut side, but rather position itself to engage with both parties. Thailand should strive to be liked by both countries. Negotiations must be skillfully conducted to create opportunities for trade and investment with both the US and China.

In terms of investment, US investment in Thailand remains low. Therefore, the government needs to set the right policy course, act professionally and build confidence to attract more trade and investment.

Tropical Storm Battering Philippines Leaves At Least 24 People Dead

MANILA, Philippines (AP) — Widespread flooding and landslides set off by a tropical storm in the northeastern Philippines on Thursday left at least 24 people dead, swept away cars and prompted authorities to scramble for motorboats to rescue trapped villagers, some on roofs.

The government shut down schools and offices — except those urgently needed for disaster response — for the second day on the entire main island of Luzon to protect millions of people after Tropical Storm Trami slammed into the country’s northeastern province of Isabela after midnight.

The storm was blowing over Aguinaldo town in the mountain province of Ifugao after dawn with sustained winds up to 95 kph (59 mph) and gusts up to 160 kph (99 mph). It was blowing westward and was forecast to enter the South China Sea later on Thursday, according to state forecasters.

At least 24 people died, mostly due to drowning in the hard-hit Bicol region and nearby Quezon province but the toll was expected to rise as towns and villages isolated by flooding and roads blocked by landslides and toppled trees manage to send out reports, police and provincial officials said.

Most of the storm deaths were reported in the six-province Bicol region, southeast of Manila, where at least 20 people died, including 7 residents in Naga city, which was inundated by flash floods as Trami was approaching Tuesday, dumping more than two months’ worth of rainfall in just 24 hours at high tide, regional police chief Brig. Gen. Andre Dizon and other officials said.

While thousands of villagers, who were trapped in floodwaters, have been rescued by government forces, many more needed to be saved Thursday in the Bicol region, including some on roofs. About 1,500 police officers have been deployed for disaster-mitigation work, Dizon said.

“We can’t rescue them all at once because there are so many and we need additional motorboats,” Dizon told The Associated Press by telephone. “We’re looking for ways to deliver food and water to those who were trapped but could not be evacuated right away.”

Flash floods swept away and submerged cars in some parts of Naga city while mudflows from Mayon, one of the country’s 24 active volcanoes, in nearby Albay province, engulfed several vehicles, Dizon said.

Stormy weather remained in the region, hampering relief efforts, officials said.

The government’s disaster-mitigation agency said more than 2 million people were affected by the storm, including 75,400 villagers who were displaced from their homes and are sheltering on safer ground.

About 20 storms and typhoons batter the Philippines each year. In 2013, Typhoon Haiyan, one of the strongest recorded tropical cyclones in the world, left more than 7,300 people dead or missing and flattened entire villages.

Thai Private Island “Koh Kham” Listed for Sale at 1.8 Billion Baht

TRAT — A social media announcement about the sale of “Koh Kham” island in Trat Province for 1.8 billion baht ($53.2 million) has created a buzz. Local officials confirm this is a genuine sale and note that the island has been traded before, likely due to construction restrictions in the area.

On October 23, Mr. Non Suwatchananon, Chief of Koh Mak Subdistrict Administrative Organization in Koh Kood District, Trat Province, revealed that Koh Kham is a small, beautiful island with fine white sand beaches. The legally documented area is only about 10 rai, and property taxes are paid to the Koh Mak SAO annually. The island has changed hands several times.

Currently, the owner of “Mum Aroi” restaurant owns the property, having bought it from several business people. Previously, Mr. Chakraphan Tawetikul, former president of Trat Tourism Business Association and former chief of Koh Mak SAO, was an owner who bought it from a local Trat resident.

The island has only one owner and no official accommodations, with only small structures present. The rest is mostly forested. Tourists can visit but must pay a landing fee.

Mr. Non’s information matches the sale announcement which states: “Private island for sale – Koh Kham, one of Thailand’s top 10 most beautiful islands, frequently reviewed by influencers. Clean, private, beautiful sea, clear water, white sand, and features a sandbar and volcanic rocks arranged like natural sculptures.”

The announcement also mentions the approximately 10 rai of private ownership, located about 35 kilometers from Laem Ngop coast in Trat province, near Koh Mak (just 1 km away), accessible by speedboat in 30-40 minutes.

The listing mentions a partially constructed resort that was halted, with an asking price of 1,800,000,000 baht.

Mr. Dechathon Chan-ob, Chief of Koh Kood SAO, added that on August 26, 2024, officials inspected resort construction on Koh Kham due to suspected sea encroachment and land encroachment.

The inspection team included Rear Admiral Sanon Cha-em, Deputy Commander of Chanthaburi and Trat Defense Force, with 50 marines, Trat Harbor Department officials, Trat Forest officials, Natural Resources and Environment office staff, and naval personnel from Trat Naval Supply Base.

The inspection revealed a seawall construction along the beach stretching over 500 meters, a 149-meter pier, and unauthorized construction of accommodation and workers’ quarters beyond the 10 rai legal boundary. They also found encroachment on hillsides for viewpoint construction and extensive forest clearing for development.

At that time, Rear Admiral Sanon stated that the relevant agencies would summarize all violations for legal proceedings. However, the Trat prosecutor later declined to file charges, and related agencies did not appeal the case.
