Thailand’s Tak Bai Case Expires, Sparks Political-Security Concerns

BANGKOK — After Thailand’s statute of limitations expired on October 25, 2024, for the 2004 Tak Bai incident that resulted in 85 deaths, various parties have shown their reactions.

In addition to political opposition and Thai activists, UN human rights experts have urged the Thai government to take immediate action to ensure accountability and uphold the rights of victims’ families to truth, justice, and reparations after two decades of waiting.

The incident occurred on October 25, 2004, when Thai security forces confronted protesters from the Malay Muslim minority community in Narathiwat Province. Seven people were reportedly killed during the initial confrontation.

Subsequently, 1,370 protesters were arrested and transported to a military camp in Pattani Province.  During the transfer of protesters onto trucks, in some vehicles protesters were forced to lie stacked on top of each other, leading to 78 deaths from suffocation.

The victims’ families filed a lawsuit this April accusing seven soldiers and officials of murder, attempted murder, and unlawful detention. This came after Amnesty International Thailand reminded them of their last chance before the statute of limitations expired.

The officials facing murder charges are mostly the drivers of the trucks, but also Gen. Pisal Wattanawongkiri, commander of the 4th Army Region at the time of the incident and Chalermchai Wirunphet the commander of the 5th Infantry Division.

Prayuth Bejraguna, a spokesperson for the Office of the Attorney General, stated on September 17 that the Attorney General’s Office received the case from police investigators in April this year and had done their best to expedite the process, resulting in the indictment decision.

“Although the eight suspects did not wish the victims to have died, getting only 25 trucks to transport more than 1,000 protesters was too crowded to be an appropriate way to transport people. The defendants’ action could be expected to result in the victims being suffocated to death,” he said.

However, after the Narathiwat Provincial Court issued arrest warrants for 7 suspects, none of them appeared on October 15. Despite authorities searching the homes of all seven suspects in various provinces such as Nonthaburi, Surat Thani, Songkhla, and Yala, they were not found.

Meanwhile, security officials have had to deal with periodic bombings in the three southern border provinces, resulting in injuries to military personnel in the area. These incidents are believed to be connected to the Tak Bai case.

Apology on Behalf of the Government

In Parliament, opposition party members criticized the government, particularly the Pheu Thai Party, for allowing General Phisan, who was an MP in the party, to take leave and flee abroad. General Phisan later sent a letter resigning from his MP position and Pheu Thai Party membership to prevent the party from being attacked for political opportunism.

However, General Phisan’s resignation didn’t seem to reduce the pressure. Activists and opposition members called for the government to issue an emergency decree to prevent the Tak Bai case from expiring under the statute of limitations, to avoid creating a culture of impunity.

They compared the Tak Bai case with other cases of political violence where state officials were never prosecuted, and attacked the Pheu Thai Party, saying they could not escape responsibility because they were formerly the Thai Rak Thai Party, which was the government 20 years ago under Prime Minister Thaksin Shinawatra.

On October 24, Prime Minister Paetongtarn Shinawatra announced that after consulting with the Council of State regarding the emergency decree to extend the statute of limitations, it cannot be done as it doesn’t meet the criteria and conditions. The Council stated that this case doesn’t meet the constitutional requirements and international criminal law principles for issuing an emergency decree.

The Prime Minister said that previous governments, including those of Thaksin Shinawatra, General Surayud Chulanont, and Yingluck Shinawatra, all shared the same regret as they are all Thai, and they provided all possible remedies to show responsibility where they could.

“This case happened 20 years ago. I am sorry for the incident and apologize on behalf of the government. From now on, we will try to work better to prevent such incidents from happening again. For those affected, I want peace to prevail. I don’t want all sides to be in conflict with each other, and please don’t link violent cases with politics,” she said.

What Follows the Tak Bai Case

Amid intense political pressure, Professor Dr. Surachart Bamrungsuk from Chulalongkorn University’s Faculty of Political Science, who has long monitored the southern border situation, says the Tak Bai case reinforces Thailand’s social division because people ignore historical facts and instead use newly constructed information for political interests.

Dr. Surachart explains that the Tak Bai case has become an awkward mixture of political and security cases after memories faded. The case actually involved four separate legal proceedings: First, a case against protest leaders for causing unrest, which the Surayud government dropped for reconciliation.

Second, a civil case leading to compensation payments. Third, a case regarding seven protesters’ deaths that concluded due to lack of evidence about who fired shots or what actually happened during the chaos.

The fourth case, concerning 78 deaths during detainee transport, included court inquiries involving General Phisan as 4th Army Region Commander since 2005. After five years, it concluded that no specific perpetrator could be identified as the deaths were caused by suffocation.

Following the case’s conclusion, during Yingluck’s administration, compensation totaling 641 million baht was provided to relatives and affected persons.

“I’m not saying compensation can replace lives – that’s a separate issue. But it has legal implications. So to say that the Thai state completely neglected the case or allowed impunity isn’t accurate, as legal processes were followed,” Dr. Surachart states.

In his article “What Follows the Tak Bai Case” in Matichon Weekly, he warns that this issue might be used to justify violent acts by insurgent groups as symbolic expression.

Therefore, the 4th Army Region may need to expedite “contingency plans” to minimize potential violence, especially civilian casualties. If protests occur, they must prevent another “Tak Bai 2” situation.

Meanwhile, since military casualties are often used to represent the success of insurgent operations, personnel protection measures should be a priority for commanders. Attacks linked to the Tak Bai case indicate insurgents’ successful political propaganda, which the government must acknowledge as the Tak Bai issue could easily become a “political crisis.” Thus, leadership must be shown by explaining both the 2004 Tak Bai problems and current related issues.

As Dr. Surachart predicted, the Tak Bai issue and southern situation were brought to Parliament. On October 25, the statute of limitations expiry date, the House of Representatives held an urgent verbal motion debate on the Tak Bai case and approved the Law, Justice, and Human Rights Committee to study and submit proposals to the government within 90 days.

Prosecutors Seek Resentencing for Erik and Lyle Menendez in 1989 Killings of Their Parents

LOS ANGELES (AP) — Erik and Lyle Menendez still have a long way to go before they can walk out of prison, even though the Los Angeles County district attorney has recommended their life-without-parole sentences be thrown out and the brothers be resentenced and immediately eligible for parole.

The brothers, convicted in the 1989 killings of their parents at the family’s Beverly Hills mansion, will need to get a judge to go along with the recommendation Los Angeles District Attorney George Gascón made Thursday and then a parole board must approve their release. The final stop is with Gov. Gavin Newsom, who could reject the board’s decision.

It’s an uncertain process likely to stretch out over months.

Lyle Menendez, then 21, and Erik Menendez, then 18, admitted they fatally shot their entertainment executive father, Jose Menendez, and their mother, Kitty Menendez. The brothers said they feared their parents were about to kill them to stop people from finding out that Jose Menendez had sexually abused Erik Menendez for years.

Prosecutors at the time contended that there was no evidence of molestation. The brothers’ first trial ended in a hung jury, and prosecutors secured a conviction in the second after much of the evidence of abuse was disallowed from the trial. The district attorney’s office also said back then that the brothers were after their parents’ multimillion-dollar estate.

Now, the DA and relatives say the world better understands the role of trauma in sexual abuse cases.

Critics accuse DA of playing politics

Meanwhile, Gascón faces fights over his resentencing recommendation: His opponent in his bid for reelection next month, as well as some of his own prosecutors, have called the latest development in the case politically motivated and the result of a recent Netflix documentary about the notorious crime.

Michele Hanisee, president of the Association of Los Angeles Deputy District Attorneys, on Wednesday said Gascón’s decision smacks of “opportunism” to get headlines.

“Throughout his disastrous tenure as DA, Gascón has consistently prioritized celebrity cases over the rights of crime victims, showing more interest in being in the spotlight than in upholding justice,” Hanisee said in a statement.

But the district attorney said he made the final decision only an hour before Thursday’s news conference and it was separate from politics.

Since their sentencing in 1996, the brothers have been model prisoners, Gascón and their attorney say, and committed themselves to rehabilitation and redemption.

“I came to a place where I believe, under the law, resentencing is appropriate,” Gascón said during the news conference.

What comes next?

Gascón’s office filed paperwork Thursday that recommends the brothers — now 54 and 56 years old — receive a new sentence of 50 years to life. Because they were under 26 years old at the time of the crimes, they would be eligible for parole immediately.

“I believe that they have paid their debt to society,” the DA said.

A hearing before a judge could come within the next month or so. If the judge agrees to the resentencing, the state parole board will hold its own proceeding to determine whether they should go free. If the board recommends parole, Newsom would have 150 days to review the case. The governor could green-light parole, or overrule the board and deny their release.

Despite Gascón’s goal of freeing the brothers, Laurie Levenson, a professor of criminal law at Loyola Law School in Los Angeles, warned that the judge would not likely be a “rubber stamp” due to dissent within the DA’s office.

“That puts the judge actually in a very challenging position,” Levenson said, noting she had not heard of any cases until recently where the head of the office disagreed with other lawyers involved in the case. Ultimately, Gascón chose the “safest route” for his decision — leaving it up to the court and parole board, she said.

Mark Geragos, an attorney for the brothers, has said he’s hopeful the brothers could be freed by Thanksgiving. Levenson called that deadline “awfully hopeful.”

Family largely unites to call for brothers’ freedom

The brothers’ extended family has pleaded for their release. Several family members have said that in today’s world — which is more aware of the impact of sexual abuse — the brothers would not have been convicted of first-degree murder and sentenced to life without parole.

Anamaria Baralt, a niece of Jose Menendez, said the district attorney’s “brave and necessary” decision means “Lyle and Erik can finally begin to heal from the trauma of their past.”

Not all Menendez family members support resentencing. Attorneys for Milton Andersen, the 90-year-old brother of Kitty Menendez, filed a legal brief seeking to keep the brothers’ original punishment.

“They shot their mother, Kitty, reloading to ensure her death,” Andersen’s attorneys said in a statement Thursday. “The evidence remains overwhelmingly clear: the jury’s verdict was just, and the punishment fits the heinous crime.”

DA’s challenger weighs in

The LA district attorney is in the middle of a tough reelection fight against former federal prosecutor Nathan Hochman, who has blamed Gascón’s progressive reform policies for recent high-profile killings and increased retail crime.

Gascón said Thursday that his office has recommended resentencing for some 300 offenders, including people behind bars for murder.

Hochman questioned the timing of the Gascón’s announcement, coming less than two weeks before the election and calling it a “desperate political move.”

He said he is unable to form his own opinion on the case without access to confidential records and relevant witnesses.

“If I become DA and the case is still pending at that time, I will conduct a review consistent with how I would review any case,” Hochman said.

Geragos said the DA took the case seriously before there was any talk of him losing reelection.

New attention to case

The case has gained new traction in recent weeks after Netflix began streaming the true-crime drama “ Monsters: The Lyle and Erik Menendez Story.”

Roy Rossello, a former member of the Latin pop group Menudo, also recently came forward saying he was drugged and raped by Jose Menendez when he was a teen in the 1980s.

Rossello spoke about his abuse in the 2023 Peacock docuseries “Menendez + Menudo: Boys Betrayed.” His allegations are part of the evidence listed in the petition filed last year by the Menendez brothers’ attorney in seeking a review of their case.

Menudo was signed under RCA Records, which Jose Menendez headed at the time.

Taxi Driver Apologies After Stabbing Aussie Passenger in Bangkok

BANGKOKPolice arrested a taxi driver who stabbed an Australian tourist passenger with a cutter after an argument over car damage payment escalated.

Thung Mahamek Police Station officers in Bangkok responded to a report of an injured foreign tourist on Narathiwat Ratchanakarin Road near Conritum mall, close to Soi Narathiwat 9, at 3:39 a.m. on October 24. Emergency responders provided first aid – the victim had normal vital signs and could communicate. He was then transported to Chulalongkorn Hospital.

After getting permission from doctors, investigators interviewed the injured man, who identified himself as Simon, age 39, from Australia. He stated that a pink taxi driver had stabbed him in the right abdomen with a cutter after an argument. When bystanders appeared, the taxi driver fled the scene.

The victim had taken a pink taxi to the incident location where an argument broke out, leading to the driver attacking him with a knife. Bystanders discovered him, and the driver fled. Emergency services took him to Chulalongkorn Hospital.

Investigators later identified the taxi driver as Mr. Samorn, age 49. After reviewing CCTV footage and interviewing witnesses, including security guards who confirmed seeing Mr. Samorn attack Simon with a cutter.

On October 24, officers brought Mr. Samorn and his taxi in for questioning at Thung Mahamek police station. He confessed to injuring the Australian man. He had picked up Simon and a Thai man from the Thaniya area, Silom Soi 2, to take them to Chatrium Hotel on Narathiwat Road.

When they reached Narathiwat Soi 9, Simon and the Thai man were arguing. Mr. Samorn stopped the car, at which point Simon strongly hit inside the car and slammed the door when getting out. Mr. Samorn got out to demand payment for damages, but this led to an argument as Simon didn’t see any damage.

As both parties became angry, Mr. Samorn grabbed a small cutter (approximately 12cm long) from his car’s storage compartment. During the argument, he waved the cutter around, cutting Simon’s abdomen. Simon sat down on the sidewalk, after which Mr. Samorn drove away and dropped off the Thai man near Silom Soi 2.

Investigators have charged the suspect with causing bodily harm to another person. Mr. Samorn has apologized to Simon with a wai gesture.
