What Happens to Trump’s Tariffs Now that a Court Has Knocked Them Down?

WASHINGTON (AP) — President Donald Trump has audaciously claimed virtually unlimited power to bypass Congress and impose sweeping taxes on foreign products.

Now a federal court has thrown a roadblock in his path.

A three-judge panel of the U.S. Court of International Trade ruled Wednesday that Trump overstepped his authority when he invoked the 1977 International Emergency Economic Powers Act to declare a national emergency and plaster taxes – tariffs – on imports from almost every country in the world.

The ruling was a big setback for Trump, whose erratic trade policies have rocked financial markets, paralyzed businesses with uncertainty and raised fears of higher prices and slower economic growth. On his Truth Social platform Thursday, he wrote: “The ruling by the U.S. Court of International Trade is so wrong, and so political! Hopefully, the Supreme Court will reverse this horrible, Country threatening decision, QUICKLY and DECISIVELY.”

Trump’s trade wars are far from over. The Court of Appeals for the Federal Circuit on Thursday allowed the president to temporarily continue collecting the tariffs under the emergency powers law while he appeals the trade court’s decision.

Jeffrey Schwab, senior counsel at the nonprofit Liberty Justice Center who represented the five small businesses that sued, called the appeals court order a mere “procedural step.” He expressed confidence that courts would block the tariffs, which represent “a direct threat” to his clients’ livelihoods.

The administration has other ways to pursue the president’s goal of using tariffs to lure factories back to America, raise money for the U.S. Treasury and pressure other countries into bending to his will.

Financial markets, which would welcome an end to Trump’s tariffs, had a muted response to the news Thursday; stocks rose modestly.

“Investors are not getting too carried away, presumably in the expectation that the White House will find a workaround that allows them to continue to pursue their trade agenda,’’ said Matthew Ryan, head of market strategy at the financial services firm Ebury.

Trump’s IEEPA tariffs are being challenged in at least seven lawsuits. In the ruling Wednesday, the trade court combined two of the cases — one brought by five small businesses and another by 12 U.S. states.

The U.S. Court of International Trade has jurisdiction over civil cases involving trade. The legal challenge to Trump’s tariff is widely expected to end up at the U.S. Supreme Court.

Which tariffs did the court block?

The court’s decision blocks the tariffs Trump slapped last month on almost all U.S. trading partners and levies he imposed before that on China, Mexico and Canada.

Trump on April 2 — Liberation Day, he called it — imposed so-called reciprocal tariffs of up to 50% on countries with which the United States runs a trade deficit and 10% baseline tariffs on almost everybody else. He later suspended the reciprocal tariffs for 90 days to give countries time to negotiate trade agreements with the United States — and reduce their barriers to American exports. But he kept the baseline tariffs in place.

Claiming extraordinary power to act without congressional approval, he justified the taxes under IEEPA by declaring the United States’ longstanding trade deficits “a national emergency.”

“The reason that he chose IEEPA was he thought he could do this unilaterally without much oversight by Congress,” Schwab said.

In February, he’d invoked the law to impose tariffs on Canada, Mexico and China, saying that the illegal flow of immigrants and drugs across the U.S. border amounted to a national emergency and that the three countries needed to do more to stop it.

The U.S. Constitution gives Congress the power to set taxes, including tariffs. But lawmakers have gradually let presidents assume more power over tariffs — and Trump has made the most of it.

Why did the court rule against the president?

The administration had argued that courts had approved then-President Richard Nixon’s emergency use of tariffs in the economic chaos that followed his decision to end a policy that linked the U.S. dollar to the price of gold. The Nixon administration successfully cited its authority under the 1917 Trading With Enemy Act, which preceded and supplied some of the legal language later used in IEEPA.

The court rejected the administration’s argument this time, deciding that Trump’s sweeping tariffs exceeded his authority to regulate imports under IEEPA. It also said the tariffs did nothing to deal with problems they were supposed to address. In their case, the states noted that America’s trade deficits hardly amount to a sudden emergency. The United States has racked them up for 49 straight years in good times and bad.

Another federal judge also blocked Trump’s use of an emergency powers law to impose tariffs on Thursday. The ruling from U.S. District Judge Rudolph Contreras came in a lawsuit from two Illinois-based educational toy companies. The ruling only blocks the collection of tariffs from the companies that sued, and was handed down the day after the trade court’s broader finding.

So where does this leave Trump’s trade agenda?

Wendy Cutler, a former U.S. trade official who is now vice president at the Asia Society Policy Institute, says Wednesday’s decision “throws the president’s trade policy into turmoil.”

Other countries may be reluctant to make concessions during Trump’s 90-day pause if there’s a chance the courts will uphold the decision striking down the IEEPA tariffs. “Can those negotiations move forward?” said Antonio Rivera, a partner at ArentFox Schiff and a former Customs and Border Protection attorney.

Likewise, companies will have to reassess the way they run their supply chains, perhaps speeding up shipments to the United States to offset the risk that the tariffs will be reinstated on appeal.

Still, the ruling leaves in place other Trump tariffs, including those on foreign steel, aluminum and autos. Those levies were invoked under a different legal authority — Section 232 of the Trade Expansion Act of 1962 — that requires a Commerce Department investigation and cannot simply be imposed at the president’s own discretion.

Trump still has the authority to raise those Section 232 tariffs. He can also pursue new ones. The Commerce Department, for instance, last month launched a Section 232 investigation into the national security implications of pharmaceutical imports.

The court also left in place tariffs Trump imposed on China in his first term— and President Joe Biden kept — in a dispute over Beijing’s use of hard-nose tactics to give Chinese companies an edge in advanced technology. The U.S. alleged that China unfairly subsidized its own firms, forced companies from the U.S. and other foreign countries to hand over trade secrets and even engaged in cybertheft. Trump has leeway to expand those tariffs if he wants to put more pressure on China.

The trade court also noted Wednesday that Trump retains more limited power to impose tariffs to address trade deficits under another statute, the Trade Act of 1974. But that law restricts tariffs to 15% and to just 150 days on countries with which the United States runs big trade deficits.

What is the likely the economic and financial fallout from the decision?

When the IEEPA tariffs were in place, America’s average tariff rate was 15%, the highest in decades and up from 2.5% before Trump’s tariff onslaught began this year. Without them, the U.S. tariff rate is still a hefty 6.5%, according to economists Stephen Brown and Jennifer McKeown of Capital Economics.

They say the U.S. economy would grow faster in the second half of 2025 — at a 2% annual rate, up from the 1.5% they’d been forecasting — without the weight of the IEEPA tariffs. Prices also wouldn’t rise as fast.

Importers may get relief. Posting on X, formerly known as Twitter, on Thursday, lawyer Peter Harrell, a fellow at the Carnegie Endowment for International Peace, wrote that if the trade court’s decision “is upheld, importers should eventually be able to get a refund of (IEEPA) tariffs paid to date. But the government will probably seek to avoid paying refunds until appeals are exhausted.″

Chiang Mai Rehearses Procedures for Granting Legal Immigration Status 

The Internal Security Affairs Bureau, Department of Provincial Administration working team visit Chiang Mai Province on May 29, 2025 to prepare for granting legal immigration status to people who have migrated to Thailand for extended periods.

CHIANG MAI — Deputy Governor of Chiang Mai Siwa Thamikanon chaired a meeting on May 29, 2025 to clarify and prepare for the implementation of granting legal immigration status and residency in Thailand in line with the Cabinet Approval.

This is ahead of the formal implementation by the Ministry of Interior. Officials from the Bureau of Internal Security Affairs (BISA), Department of Provincial Administration, were present to provide guidance and ensure that the correct procedures are understood.

The initiative stems from a Cabinet meeting on October 29, 2024, where officials discussed solutions to problems related to statelessness and the legal status of people who have resided in Thailand for an extended period of time, including children born in the Kingdom.

The proposal submitted by the National Security Council (NSC) was approved to allow long-term migrants, especially ethnic minorities, who are currently awaiting status determination to quickly obtain legal immigration status and residence permits (through a residence certificate).

The government is endeavouring to streamline and reduce the processing time from 270 days to just 5 days. To achieve this, the Ministry of Provincial Administration has tasked BISA to explain the procedures to provincial officials nationwide.

The groups eligible for this status are divided into two categories:

  1. People who have immigrated to Thailand and have lived in Thailand for a long time, such as ethnic minorities.
  2. Their children who were born in Thailand but have not obtained Thai citizenship.

Other groups such as migrant workers, refugees or foreigners with passports are not covered by this cabinet decision.

In Chiang Mai province, there are 75,935 people who are stateless or have no legal registration status. During May 29-30, 2025, BISA officials visit Wiang Haeng and Chiang Dao districts to advise local officials in charge of citizenship and legal status issues.

They also review the application documents submitted by authorised persons to reduce red tape and close loopholes for corruption. The official implementation of this measure is expected to begin at the end of June 2025, subject to publication in the Royal Gazette.

Following the meeting, Chiang Mai may invite district chiefs, deputy district chiefs and relevant officials to further discussions across the province based on the BISA’s recommendations.

Each district and commune chief will then be tasked with interviewing and briefing eligible individuals to ensure that all required documents are ready and submitted correctly. This will help to speed up processing and improve administrative efficiency.

Meanwhile, Interior Ministry spokesperson Trisalee Trisornakul announced in Bangkok on May 30 that the ministry has instructed all districts to prepare operational procedures for granting foreign status according to the Cabinet resolution of October 29, 2024, with applications accepted starting June 30.

The process involves five steps:
1. Target Group Meetings – Districts will visit target areas to verify document accuracy, qualifications, and evidence before the law takes effect.
2. Document Screening – Officials will review and screen all documentation.
3. Complete Documentation – When documents are verified as complete and accurate, districts may record the individuals’ names and notify them of their eligibility to apply.
4. Incomplete Documentation – If documents are incorrect, districts must schedule appointments for applicants to correct survey forms.
5. Local Adaptation – Each district can adjust the preparation procedures to suit local contexts for maximum service efficiency.

The ministry emphasized that districts have flexibility to modify procedures according to their specific circumstances to provide the most effective service to residents.

US Scholar Leaves Thailand After Charges of Insulting Monarchy Are Dropped

BANGKOK (AP) — Thailand’s attorney general’s office has confirmed that it will not prosecute an American academic arrested in early April on a charge of royal defamation, his lawyer said Thursday. The offense is punishable by up to 15 years in prison.

Paul Chambers, who had been employed as a political science lecturer at Naresuan University in the northern province of Phitsanulok, departed Thailand after the ruling, said his lawyer, Akarachai Chaimaneekarakate, who declined to reveal his destination.

The attorney general’s office had already announced on May 1 that it did not intend to press charges against 58-year-old Chambers, an Oklahoma native, due to lack of evidence. But it had allowed the police in northern Thailand, which originally handled the case, to review its decision.

The group Thai Lawyers for Human Rights, which aided Chambers’ defense, said on its website that police contested the decision, which was then referred back to the attorney general, who in turn reaffirmed his own office’s decision to drop charges.

An appeal of the revocation of Chambers’ Thai visa, and another contesting his firing by Naresuan University are still pending, Akarachai said.

Chambers’ arrest drew concern from the academic community, especially from Asian scholars around the world, as well as from the U.S. government over free speech restrictions.

Thailand’s lese majeste law calls for 3-15 years imprisonment for anyone who defames, insults or threatens the king, the queen, the heir apparent or the regent. Critics say it is among the harshest such laws anywhere and has also been used to punish critics of the government and the military.

The monarchy has long been considered a pillar of Thai society and criticizing it used to be strictly taboo. Conservative Thais, especially in the military and courts, still consider it untouchable.

Chambers has specialized in studying the power and influence of the Thai military, which plays a major role in politics. It has staged 13 coups since Thailand became a constitutional monarchy in 1932, most recently 11 years ago. He was arrested on a complaint made by the northern regional office of the army’s Internal Security Operations Command.

One of its officers told a parliamentary inquiry that it filed the complaint based on a Facebook post that translated words from a website operated by ISEAS–Yusof Ishak Institute, a think tank in Singapore, about a webinar on Thai politics that included as Chambers as a participant.

Chambers’ supporters said that the blurb for the webinar, which was cited in his charge sheet as evidence, was not written by him.

Pattaya Condo Pledges Compensation After Panel Injures Australian Man

PATTAYABang Lamung District Chief and Pattaya City Mayor are closely monitoring the incident where a cement shimplate (concrete reinforcement plate) from a condominium collapsed and injured an Australian male tourist, also damaging several motorcycles belonging to residents.

The incident occurred around 5:30 a.m. on May 28, when a decorative cement shimplate from the side of a condominium building in Khao Phra Tamnak area collapsed onto a poolside gazebo where Mr. Smith, a 57-year-old Australian tourist, was sitting. He suffered injuries including a broken leg and head trauma. Several motorcycles belonging to residents were also damaged, causing widespread concern among building occupants.

Pattaya City Mayor Poramase Ngampichet stated that the juristic person must compensate for damages and medical treatment for the injured party. Initial inspections confirmed that the building’s structure is not compromised, but concerns remain about the three remaining cement shimplates on other sides of the building after one has already fallen.

“We have cordoned off areas that may be affected and are directing people to avoid those pathways. We’re having the building’s juristic person manage the situation to minimize inconvenience to residents, as the safety of lives and property is our top priority,” the mayor said.

Building Manager Suvit Chaisatra confirmed that all relevant parties and residents have been notified, and the incident area has been strictly cordoned off. Future plans include removing all remaining decorative shimplate components to prevent similar incidents, while ensuring residents that the building’s structure remains safe.

“Regarding the injured person, the juristic person has been regularly checking on his condition and has confirmed that proper compensation will be provided, including for the damaged motorcycles,” he said.

Bang Lamung District Chief Patcharapat Srithanyanan later announced investigation results, confirming that the fallen cement shimplate was a decorative element from the 37th floor that detached from the building structure without affecting the building’s structural integrity. Pattaya City has conducted structural safety inspections.

The 45-story condominium, built approximately 8 years ago with over 1,000 units, is managed by a juristic person and falls under the Building Control Act. Pattaya City has engineers regularly monitoring such high-rise buildings.

Following the Myanmar earthquake that caused the collapse of the Office of the Auditor General building in Bangkok on March 28, this condominium underwent additional structural integrity checks.

The fallen cement shimplate serves as building ornamentation that may deteriorate over time, causing it to fall. The remaining three shimplates on the adjacent floor will be brought to a meeting for approval to remove, ensuring resident confidence.

Regarding viral images showing the building appearing tilted, officials clarified these were taken from a mountain angle, creating a misleading perspective.

Thai and Cambodian Armies Agree To Withdraw From Disputed Area After Deadly Border Clash

BANGKOK (AP) — The army chiefs of Thailand and Cambodia agreed on Thursday for a mutual withdrawal from the disputed border area where a brief clash a day earlier killed one Cambodian soldier.

Cambodian troops were conducting a routine patrol along the border when the Thai side opened fire, Cambodia said Wednesday. The Thai army said that the Cambodian soldiers entered a disputed area and opened fire when Thai soldiers approached to negotiate.

The clash lasted about 10 minutes until local commanders spoke to each other and ordered a ceasefire, the Thai army said.

Gen. Pana Claewplodtook, the Thai army chief, met with Cambodian counterpart Gen. Mao Sophan at a border checkpoint and expressed his condolences over the death of the Cambodian soldier, Thai army spokesperson Winthai Suvaree said.

Winthai said both sides agreed to a withdrawal and will seek peaceful solutions together through special joint committees on border situations between the two countries in the coming weeks. He said that the troops from both sides had already stepped back from the area of the clash.

Thai Prime Minister Paetongtarn Shinawatra said on Thursday before the talks that she was confident of a positive development for the border situation, and that both sides agreed that they don’t wish for violence.

Prime Minister Hun Manet of Cambodia posted on his Facebook that officials of the two countries wanted to prevent further clashes and normalize the situation. But he also said Cambodia has sent troops and weapons as reinforcement to the disputed border.

“I do not want to see any fighting between armies that does not bring any benefits to our two countries and peoples, especially those who are fighting directly on the front lines.” He said.

Neighboring Thailand and Cambodia have a long history of land disputes. The most prominent involved the Preah Vihear promontory, an area around a 1,000-year-old temple that was listed as a UNESCO world heritage site in 2008. The U.N.’s International Court of Justice granted sovereignty over the area to Cambodia in 2013.

There have been recent border incidents between the two countries, including in February when Cambodian troops and their family members entered an ancient temple along the border and sang the Cambodian national anthem, leading to a brief argument with Thai troops.

Thai Police Crack Down on International Scam Ring After 5-Year Probe

BANGKOKThai authorities arrested nine suspects in a sweeping operation targeting an international fraud network that defrauded victims of more than $60 million through fake medical equipment sales during the COVID-19 pandemic.

The Department of Special Investigation (DSI) conducted coordinated raids across 11 locations in eight provinces on Thursday, culminating a five-year investigation that began during the 2020 coronavirus outbreak. The operation targeted a transnational scammer ring that operated thousands of fraudulent websites selling non-existent medical supplies.

International Victims, Massive Losses

The fraud network, which caused total damages exceeding 2 billion baht ($61 million), targeted approximately 114 victims in 15 countries/territories, including Taiwan, Turkey, the United Arab Emirates, the Netherlands, Egypt, the United Kingdom, Vietnam, Sri Lanka, Spain, Australia, the United States, Japan, Singapore, Thailand, and Malaysia. Among those defrauded was a Vietnamese national who lost over 8 million baht ($245,000) and traveled to Thailand to observe the proceedings.

The scammers posed as legitimate medical equipment suppliers, offering products including face masks, medical gloves and other COVID-era essentials that were never delivered to buyers.

Foreign Nationals Led Operation

Investigators arrested three foreign nationals and four Thai accomplices during Thursday’s raids. The foreign suspects include one Nigerian man apprehended in Bangkok, one Cameroonian man in Chanthaburi province, and one Cameroonian English teacher detained in Krabi province.

The operation was led by foreigners married to Thai women, who used their local connections to establish seemingly legitimate businesses as fronts for the fraud scheme.

Dramatic Bangkok Warehouse Raid

The most dramatic arrest occurred at a Bangkok warehouse housing Falcon Junior Export Cargo Co., Ltd. on Phetchaburi Road. When DSI officers arrived with search warrants, no one responded to calls to open the facility.

Deputy DSI Director-General Pol. Lt. Col. Wisanu Chimtrakul and Technology Crime Division Director Pol. Lt. Col. Khemchat Prakaiongmanee led the team that forced entry into the two-story warehouse complex. Officers initially found the building empty but eventually discovered two suspects hiding under a staircase.

Money Laundering Through Cryptocurrency

Authorities became suspicious when they noticed company revenues didn’t match the massive cash flows involved. Investigation revealed the criminals used proxy bank accounts to receive funds, which were then converted to cryptocurrency to obscure the money trail.

The main suspect, 55-year-old Nigerian national Mr. Levinus, who owned the company, faces multiple charges including participation in transnational organized crime, computer fraud, public deception, and money laundering conspiracy.

Long Investigation Yields Results

Pol. Lt. Col. Khemchat said the DSI began investigating the network during the COVID outbreak but only classified it as a special case two years ago. The investigation involved coordination between multiple agencies and extensive forensic analysis.

Authorities have issued arrest warrants for 24 individuals total. Seized assets include vehicles, cash, and cryptocurrency holdings.

The Anti-Money Laundering Office (AMLO) will handle the civil proceedings to distribute recovered assets back to defrauded victims, officials said.
