Did Trump Break the Law? FBI Search Raises Fresh Questions

WASHINGTON (AP) — The year was 2016, the presidential candidate under investigation was Hillary Clinton and the FBI director at the time, James Comey, laid out the factors the Justice Department weighs in deciding whether to charge someone with mishandling classified records.

Fast forward to 2022 and that tutorial proves instructive as another candidate from that election, Donald Trump, is entangled in an FBI probe related to sensitive government documents.

Whether an FBI search of Trump’s Mar-a-Lago residence is a prelude to criminal charges is unknown. The action Monday nonetheless focuses attention on the thicket of statutes that govern the handling of government records, though the department’s own history of prosecutorial discretion — some high-profile investigations have ended without charges or in misdemeanor plea deals — makes it hard to forecast with certainty what might happen this time.

“These are statutes that have historically not been enforced to the fullest extent,” said University of Texas law professor Stephen Vladeck.

Much remains uncertain about Monday’s search, including precisely what documents the FBI was looking for — Trump says agents opened a safe — or why it acted when it did. But people familiar with the matter say it relates to an ongoing Justice Department investigation into the discovery of classified material in boxes of White House records the National Archives and Records Administration recovered from Mar-A-Lago earlier this year.

To obtain a search warrant, the Justice Department would have had to persuade a judge that probable cause existed that a crime was committed, though what statute officials think may have been violated is unclear.

Multiple federal laws require the safekeeping of government secrets. One potentially relevant statute makes it a crime to remove classified information and retain it an unauthorized location. Another makes it illegal to mishandle national defense information, including maps, photographs and documents, or transmit it to a person not authorized to receive it.

But if past is any precedent, the mere mishandling of classified information isn’t always enough for a felony conviction — or any charges at all.

“It often comes down to whether there are aggravating factors in these cases,” said David Laufman, a Washington lawyer who as head of the Justice Department’s counterintelligence and export control section oversaw the Hillary Clinton investigation.

Those include, he said, how much classified information was mishandled, the extent to which the person knew they were in possession of classified information and how sensitive the material was and whether its exposure placed at risk U.S. national security.

The FBI said as much in 2016 when it closed without recommending charges an investigation into whether Clinton mishandled classified information via a private email server she used as secretary of state. Comey said agents had determined that she had sent and received emails containing classified information but that there was no indication she had intended to break the law. He said no reasonable prosecutor would have brought such a case.

To prove his point, he said a review of past Justice Department cases established that each prosecution involved some combination of: an intentional mishandling of classified records; the vast exposure of materials in a way that suggested willful misconduct, disloyalty to the U.S. or obstruction of justice.

In another notable case, former CIA Director David Petraeus was permitted in 2015 to plead guilty to a misdemeanor charge of the unauthorized removal and retention of classified information, avoiding prison as he admitted sharing notebooks containing government secrets with his biographer. That resolution came two years after an FBI search of his home and despite an acknowledgment by Petraeus that he knew the information he was sharing was classified.

It remains to be seen what arguments Trump might raise as the investigation progresses. His lengthy statement disclosing the search did not address the substance of the probe, complaining instead that the FBI’s action was a “weaponization of the Justice System and an attack by Radical Left Democrats.”

Christina Bobb, a lawyer for Trump, said in an interview that aired on Real America’s Voice on Tuesday that supporting documentation for the warrant remained sealed and that she had not seen it. But she said investigators said they were “looking for classified information that they think should not have been removed from the White House, as well as presidential records.”

She asserted that the president himself gets to decide what is a presidential record, and it is true that Trump could argue that as president until Jan. 20, 2021, he was the original classification authority and had declassified on his own the classified material recovered from Mar-a-Lago.

But, law professor Vladeck said, it would be a “pretty stunning” argument by Trump to claim as his defense that he had “declassified all of our crown jewels” and, by doing so, effectively admit that he was a “threat to our national security.”

And, Laufman said, “The fact that he has legal authority doesn’t mean…that anything he might have chosen to take from the White House and squirrel away at Mar-a-Lago is declassified. The declassification process does not exist in Donald Trump’s head. It’s not self-executing.”

It is also possible he might say he was unaware of the content of the boxes as they were being packed. His son Eric told Fox News that boxes were among items that got moved out of the White House during “six hours” on Inauguration Day. But even if that’s the case, he would still have had a legal obligation once he learned of the presence of classified information to return it, Laufman said.

There are other statutes that could come into play that don’t explicitly concern classified information. One particular law makes it a felony for someone in possession of government records to willfully mutilate, obliterate or destroy them. That law is punishable by up to three years in prison and says that anyone convicted of it is disqualified from holding future office, though the qualifications of who can run for president are established by the Constitution.

In any event, key unanswered questions remain, including whether the investigative focus is on “the act of keeping all this material at Mar-a-Lago” or on what the material actually is, Vladeck said.

Given that mystery, he said, “We won’t know for sure until we know for sure.”

The Cambodian Labour Ministrer also gave a speech, praising the migrant workers for their contributions to the economic growth of both countries. At last, he praised CP Foods’ plant and Nakhon Ratchasima province for taking good care of over 2,200 Cambodian migrant workers.

Sornkrit Wattasiri, Senior Vice President – HR Livestock Business at CP Foods, said Cambodian workers are an important driving force for CP Foods, helping the company to produce high quality foods for consumers across the globe.

The Nakhon Ratchasima chicken processing plant has approximately 8,800 employees, consisting of 2,268 Cambodian employees and 6,600 Thai employees. All of them are working under Thai Labor standards (TLS 8001-263) that is on par with internationally-recognized labour requirements. Moreover, CP Foods has worked closely with government agencies, associations and relevant civil society sectors to verify that all workers regardless of their nationalities are treated with respect and dignity. This is to ensure a fair and transparent food supply chain.

Sornkrit added that CP Foods has a policy to employ all migrant workers as employees of the company to provide the benefits and welfare that are on par with Thai staff. In addition, the chicken processing plant provides Cambodian workers with dormitory, transportation, and interpreters to communicate and provide assistance to migrant workers in matters of work and life.

The Company, in collaboration with the Labour Promotion Network Foundation or LPN Foundation, has created a holine channel for workers to voice their concerns, Labour Voice by LPN. The hotline provides translator to allow the migrant employees to discuss, consult and file complaints in their native language. CP Foods and LPN also host human rights training for employees to help them understand their rights.

He added that, during the Covid-19 crisis, CP Foods has rigorously upgraded its epidemic prevention measures to ensure that all employees work safely in all situations and devoting every aspect to support all employees, including Cambodians.

Bangladesh Seeks China Help To Repatriate Rohingya Refugees

DHAKA, Bangladesh (AP) — Bangladesh on Sunday sought cooperation from China to repatriate Rohingya refugees to Myanmar during a visit by Foreign Minister Wang Yi, who promised better trade ties, investment and support for infrastructure development in the South Asian nation.

China had used its influence in Myanmar to broker a November 2017 agreement to repatriate about 700,000 Rohingya Muslim refugees who fled persecution in Myanmar in August that year. Despite attempts to send them back, the refugees refused, fearing danger in Myanmar, which was exacerbated by the military takeover last year.

Wang arrived in Dhaka on Saturday and met with Prime Minister Sheikh Hasina and Foreign Minister A.K. Abdul Momen. They discussed bilateral and global issues before his departure Sunday, said Shahriar Alam, Bangladesh’s junior minister for foreign affairs.

Bangladesh has strong relations with China, which is a major trade partner mostly for raw materials. But maintaining close ties with Beijing is challenging for Bangladesh, which also balances diplomatic and trade relationship with both India and the United States, China’s main rivals.

More than 500 Chinese companies are active in Bangladesh. China is involved in the country’s all major infrastructure projects such as seaports, a river tunnel and highways, and helped build its largest bridge over the River Padma at a cost of $3.6 billion.

Amid recent tensions between China and Taiwan, Bangladesh issued a statement reiterating its support for the “one-China” policy. After winning elections in 2008, Hasina’s administration closed the Taiwanese business representative office in Dhaka in response to a request from China, and since then China has increased its engagement in Bangladesh.

Bangladesh’s garment industry, which brings in more than 80% of foreign currency from exports, is heavily dependent on China for raw materials.

On Sunday, Wang told Hasina during a courtesy call that his country considers Bangladesh as a “strategic development partner” and would continue to support it, said Ihsanul Karim, the presidential press secretary.

The United News of Bangladesh agency reported that Wang also promised to stand beside Bangladesh “on all issues at international forums.”

The Bangladesh Sangbad Sangstha, state-run news agency, reported that Hasina raised the global tensions caused by the Russian invasion of Ukraine and Western sanctions against Moscow, saying “people (across the world) are enduring difficult times … South Asia, Southeast Asia and China can work together for economic progress.”

Alam said that Wang agreed to expand trade benefits by raising to 98% duty-free access from current 97% of Bangladeshi products and services to Chinese markets.

“It’s a good news for Bangladesh as we have a thriving economy based on exports,” Alam said. “Now they have offered another 1% from Sept. 1,” he said, adding that the new tax advantage is likely to include garments, woven and other products that had previously faced some barriers.

He said Bangladesh would get a list from China soon about the products and services that would get duty-free access.

Alam said that Wang explained to the Bangladeshi foreign minister that “some countries misunderstand and misinterpret” China. He did not elaborate.

But Momen told reporters separately that the Chinese minister mentioned that a section of Taiwanese people was being provoked against the sovereignty of China. Beijing considers self-governed Taiwan to be its own territory.

The junior minister said China pledged to work continuously to resolve the Rohingya crisis and quoted Wang as saying that Myanmar’s internal challenges were troubling other countries.

”Our foreign minister strongly reiterated that Chinese cooperation is needed. China has progressed on resolving the Rohingya issue and we need the situation to come to an end,” Alam said.

On Sunday, Bangladesh and China signed or renewed four agreements and memorandums of understanding on disaster management, infrastructure and cultural exchanges.

Analyst Munshi Faiz Ahmad, who served as Bangladeshi ambassador in Beijing, said Wang’s visit was very significant for both countries.

“To resolve the Rohingya crisis Bangladesh needs support from China. This visit will help strengthen the bilateral relations,” Ahmad told The Associated Press.

“To us, China is very important. We also need to maintain good relations with both India and the United States as they are also very important development partners of Bangladesh. There is nothing to be afraid of because of Bangladesh’s close ties with China,” he said.

Cease-fire Between Palestinians, Israel Takes Effect in Gaza

GAZA CITY, Gaza Strip (AP) — A cease-fire between Israel and Palestinian militants took effect late Sunday in a bid to end nearly three days of violence that killed dozens of Palestinians and disrupted the lives of hundreds of thousands of Israelis.

The flare-up was the worst fighting between Israel and Gaza militant groups since Israel and Hamas fought an 11-day war last year, and adds to the destruction and misery that have plagued blockaded Gaza for years.

The Egyptian-brokered cease-fire took effect at 11:30 p.m. (2030 GMT; 4:30 p.m. EDT). Israeli strikes and militant rockets continued in the minutes leading up to the beginning of the truce, and Israel said it would “respond strongly” if the cease-fire was violated.

Israeli aircraft have pummeled targets in Gaza since Friday, while the Iran-backed Palestinian Jihad militant group has fired hundreds of rockets at Israel in response. The risk of the cross-border fighting turning into a full-fledged war remained as long as no truce was reached. Israel says some of the dead were killed by misfired rockets.

Gaza’s ruling Hamas group remained on the sidelines, possibly because it fears Israeli reprisals and undoing economic understandings with Israel, including Israeli work permits for thousands of Gaza residents, that bolster its control.

Israel launched its operation with a strike Friday on a leader of the Islamic Jihad, and followed up on Saturday with another targeted strike on a second prominent leader.

The second Islamic Jihad commander, Khaled Mansour, was killed in an airstrike on an apartment building in the Rafah refugee camp in southern Gaza late Saturday, which also killed two other militants and five civilians.

Mansour, the Islamic Jihad commander for southern Gaza, was in the apartment of a member of the group when the missile struck, flattening the three-story building and badly damaging nearby houses.

“Suddenly, without warning, the house next to us was bombed and everything became black and dusty with smoke in the blink of an eye,” said Wissam Jouda, who lives next to the targeted building.

Ahmed al-Qaissi, another neighbor, said his wife and son were among the wounded, suffering shrapnel injuries. To make way for rescue workers, al-Qaissi agreed to have part of his house demolished.

As a funeral for Mansour began in the Gaza Strip on Sunday, the Israeli military said it was striking suspected “Islamic Jihad rocket launch posts.” Smoke could be seen from the strikes as thumps from their explosions rattled Gaza. Israeli airstrikes and rocket fire followed for hours as sirens wailed in central Israel. As the sunset call to prayer sounded in Gaza, sirens wailed as far north as Tel Aviv.

Israel says some of the deaths during this round were caused by errant rocket fire, including one incident in the Jebaliya refugee camp in northern Gaza in which six Palestinians were killed Saturday. On Sunday, a projectile hit a home in the same area of Jebaliya, killing two men. Palestinians held Israel responsible, while Israel said it was investigating whether the area was struck by an errant rocket.

Israel’s Defense Ministry said mortars fired from Gaza hit the Erez border crossing into Israel, used by thousands of Gazans daily. The mortars damaged the roof and shrapnel hit the hall’s entrance, the ministry said. The crossing has been closed amid the fighting.

The Rafah strike was the deadliest so far in the current round of fighting, which was initiated by Israel on Friday with the targeted killing of Islamic Jihad’s commander for northern Gaza.

Israel said it took action against the militant group because of concrete threats of an imminent attack, but has not provided details. Caretaker Prime Minister Yair Lapid, who is an experienced diplomat but untested in overseeing a war, unleashed the offensive less than three months before a general election in which he is campaigning to keep the job.

In a statement Sunday, Lapid said the military would continue to strike targets in Gaza “in a pinpoint and responsible way in order to reduce to a minimum the harm to noncombatants.” Lapid said the strike that killed Mansour was “an extraordinary achievement.”

“The operation will continue as long as necessary,” Lapid said.

U.S. President Joe Biden said he welcomed the ceasefire between Israel and Gaza-based militants.

“Over these last 72-hours, the United States has worked with officials from Israel, the Palestinian Authority, Egypt, Qatar, Jordan, and others throughout the region to encourage a swift resolution to the conflict,” he said in a statement.

The U.N. Security Council scheduled an emergency meeting for Monday on the violence. China, which holds the council presidency this month, scheduled the session in response to a request from the United Arab Emirates, which represents Arab nations on the council, as well as China, France, Ireland and Norway.

“We underscore our commitment to do all we can towards ending the ongoing escalation, ensuring the safety and security of the civilian population, and following-up on the Palestinian prisoners file,” said U.N. Special Coordinator for the Middle East Peace Process, Tor Wennesland, in a statement.

Israel estimates its airstrikes killed about 15 militants.

Islamic Jihad has fewer fighters and supporters than Hamas, and little is known about its arsenal. Both groups call for Israel’s destruction, but have different priorities, with Hamas constrained by the demands of governing.

The Israeli army said militants in Gaza fired about 580 rockets toward Israel. The army said its air defenses had intercepted many of them, with two of those shot down being fired toward Jerusalem. Islamic Jihad has fewer fighters and supporters than Hamas.

Air raid sirens sounded in the Jerusalem area for the first time Sunday since last year’s Israel-Hamas war.

Jerusalem is typically a flashpoint during periods of cross-border fighting between Israel and Gaza. On Sunday, hundreds of Jews, including firebrand ultra-nationalist lawmaker Itamar Ben Gvir, visited a sensitive holy site in Jerusalem, known to Jews as the Temple Mount and to Muslims as the Noble Sanctuary. The visit, under heavy police protection, ended without incident, police said.

Such demonstrative visits by Israeli hard-liners seeking to underscore Israeli claims of sovereignty over contested Jerusalem have sparked violence in the past. The holy site sits on the fault line of the Israeli-Palestinian conflict and is central to rival narratives of Palestinians and Israeli Jews.

In Palestinian cities and towns in the West Bank, Israeli security forces said they detained 19 people on suspicion of belonging to the Islamic Jihad during overnight raids.

By Sunday, Hamas still appeared to stay out of the battle. The group has a strong incentive to avoid another war. Last year’s Israel-Hamas war, one of four major conflicts and several smaller battles over the last 15 years, exacted a staggering toll on the impoverished territory’s 2.3 million Palestinian residents.

Since the last war, Israel and Hamas have reached tacit understandings based on trading calm for work permits and a slight easing of the border blockade imposed by Israel and Egypt when Hamas overran the territory 15 years ago. Israel has issued 12,000 work permits to Gaza laborers, and has held out the prospect of granting another 2,000 permits.

The lone power plant in Gaza ground to a halt at noon Saturday due to lack of fuel. Israel has kept its crossing points into Gaza closed since Tuesday. With the new disruption, Gazans can use only four hours of electricity a day, increasing their reliance on private generators and deepening the territory’s chronic power crisis amid peak summer heat.

Opinion: Mountain B Pub Fire: Why Safety Culture Is Abysmally Low in Thailand

The man-made Mountain B pub fire tragedy which led to at least 15 deaths and dozens of injuries was basically preventable. Police confirmed hours after the fire that one exit door was locked, the operator had no license to operate a pub, the place used inflammable acoustic foam panels and more.

Such tragedy is more about why it kept occurring than what to do – the latter should be more of a common sense.

Before this writer goes into speculating of the why, let’s note what more do we know so far about the preventable tragedy, where disturbing footages showed the more fortunate one rehashing out of the now completely-burnt down pubs with fire on their bodies – something too disturbing to share a link here.

Assistant police commissioner Pol. Lt. Gen. Sompong Chingduang said on Friday after initial investigation on the fire that at least on exit door was locked when the fire broke out after 1am in Chonburi province. He said it is unclear how many exit doors existed and how many of them were locked.

What’s more, additional construction was also added without permission. Only two fire extinguishers were found inside the establishment, which was almost completely burnt down.

Back on July 16, local police visited the place after having received a complaint of noise. Parts of the building were covered with highly inflammable acoustic foam panels.

Imagine if the pub did not lock that one exit door (or possibly more), the death toll would have been considerably lower. Imagine if they were more careful and refrain from using highly inflammable acoustic foam panels which simply supercharged the spread of the fire, imagine if police and related government agencies routinely and dutifully inspect the pub and others, imagine how many lives would have been spared.

Here are four factors why I think the concept of safety is abysmally low in Thailand.

First, profits and corruption trump all else. From the short-term myopic profit-making point of view, it is easier to control possible unauthorized entrance into the pub by locking its rear exit. If the pub operator did not lock it, they would have to hire at least another security staff to man the exit if not more.

A singer at the burnt-down pub said the pub always locked the two rear exit doors in fear of customers leaving without paying. Apparently, it was a fatal cost-cutting strategy.

Thanapat “Peach” Puangpae, 24, told reporters on Saturday after laying flowers for the deceased that he always entered the pub from one of the backdoors and a guard would come to unlock it and then lock it again after the musicians entered.

He admitted he did not think such tragedy would occur. On the other hand, government officials have failed to ensure that these exits are not locked, and it is possible that they turned a blind eye due to corruption.

Second, carelessness, or this may happen to others but not us mentality. Would the owner have done differently, not locking the exit doors, chose fire retardant acoustic foam, and more if they are aware that the risk of a tragedy is high? Probably yes, but again, they probably think the risk is low and it would not happen to them.

Third, other people’s lives are less important than that of yours and your family. The pub owner and operator would possibly subject their families to such a low safety standard.

Last but not least, all these factors (and possibly more) combined means safety is an alien concept for many Thais. A similar incident occurred back in 2009 in Bangkok at Zantika Pub in Ekkamai where 69 died. Apparently, it is all but forgotten with little or no lesson learned.

Bangkok, August 4, 2022 – As part of its 3M Moves campaign, 3M made a donation of 3M products to the Donation Center of the Ministry of Social Development and Human Security to be delivered to those in need in the society. 

3M Moves, a fitness initiative, was recently premiered in Thailand under a collaboration with the Sports Authority of Thailand (SAT) to organize health promotion activities and encourage Thai people to exercise in different ways under the concept “Move More, Give More”. Every step was collectively counted through online platforms so that everyone could participate with convenience anywhere anytime. This campaign was hosted from June 21 – July 23, 2022, when every 5,500 steps would translate into a piece of 3M product to be donated to the Donation Center at the end of the campaign. 

With 3M’s commitment to promoting the health and well-being of Thai people and close cooperation from its partners, 1,698 people participated in the campaign, accumulating a total of 18,377,106 steps. Through this initiative, 3M donated 950 pieces of its products worth 222,732 baht to the Donation Center to be used to support good health and hygiene of beneficiaries.

 

Mrs. Wiyada Srinaganand, Country Leader, 3M Thailand noted “With 3M’s commitment to applying science to elevate the quality of life and contribute to the society, we are honoured to play a part to promote wellness through the 3M Moves campaign, which aimed to encourage people to exercise and be conscious of their health, and give back to the society through our products. Apart from the collaboration with SAT, 3M also teamed up with Coach Fasai Puengudom, a well-known fitness specialist, to host an online boost-up campaign to share simple workout techniques for participants via online channels. 

To celebrate the 55year anniversary of 3M Thailand, the company also organized health promotion activities internally for employees by inviting them to send photos or videos of their own ways of exercises to receive 3M Moves shirts as souvenirs for their participation in the campaign.
