BANGKOK — The President of the Court of Appeal for Specialized Cases has ordered the transfer of a legal dispute involving Nestlé and the Mahagitsiri family from Minburi Civil Court to the Central Intellectual Property and International Trade Court (IPIT Court), according to a ruling read on June 20, 2025.
The case, numbered Black Case No. Phor 571/2568, was moved following Nestlé’s petition to determine proper jurisdiction between the two courts. The transfer suggests the dispute involves intellectual property or trade-related matters, though specific details of the legal conflict were not disclosed.
Despite the ongoing litigation, Nestlé emphasized that its Nescafé operations in Thailand remain unaffected. The multinational food and beverage company confirmed it continues all business activities including manufacturing, toll-manufacturing, importing, and distribution of Nescafé products across the country.

“Nescafé products are now available with the same great taste and high quality,” the company stated, seeking to reassure consumers about product availability and standards.
Nestlé also reaffirmed its long-term commitment to the Thai market, highlighting plans to continue local coffee bean procurement from Thai farmers – a practice maintained over several years.
The company indicated it will sustain investments in Thailand to benefit various stakeholders including customers, consumers, employees, farmers, and business partners.
The case transfer to the specialized IP court indicates the dispute likely involves trademark, patent, or other intellectual property issues, though the company has not disclosed the nature of its disagreement with the Mahagitsiri family.
Nestlé’s emphasis on business continuity suggests the company is working to minimize any potential market disruption while the legal proceedings unfold in the appropriate specialized jurisdiction.
