Three Thais Falls Victim To Human Trafficking In Taiwan

Bangkok – Three Thais had been deceived by a human trafficking syndicate that promised them employment in Taiwan. When they arrived in Taiwan, they were abandoned on a mountain.

Ekaphop Leuangprasert, the founder of the Saimai Tong Rod (Sai Mai must survive)  foundation, succeeded in helping three Thais to report their situation to the Central Investigation Bureau of the Royal Thai Police on November 7.

The victims are asking the police and the Ministry of Labor for help to catch the culprits behind this human trafficking. This is worrying because these traffickers create seemingly legitimate profiles and use social media to deceive potential victims who hope to find better job opportunities abroad, for example in South Korea or Taiwan.

Many people have fallen for this scam and ended up losing money for traveling expenses, only to be stranded or even forced to work in terrible conditions.

Furthermore, it has been found that these trafficking groups often operate under the guise of travel companies before exploiting the workers they smuggle in. This has also had a negative impact on Thailand’s reputation and has led to misunderstandings among Thai tourists who may be falsely associated with these illegal activities.

DeeMoney increases cross-border payments to Myanmar market

DeeMoney partners with SCB to facilitate secure cross-border money transfers, expanding access to the Myanmar market

Sawasdee Shop Co., Ltd., operating as a fintech company, introduced the DeeMoney platform, a robust Thai cross-border transaction system supporting over 26 currencies across 50 countries globally. This company has solidified a business partnership with Siam Commercial Bank, announcing their collaboration to enhance the money transfer service from Thailand to Myanmar. The focus lies in developing cross-border money transfer services that are not only easy, convenient, and swift but also offer superior exchange rates compared to the existing market rates. The primary goal is to facilitate over 2 million Myanmar workers, including small and medium-sized business operators (SMEs), seeking to transfer money back to Myanmar. The aim is to establish itself as the preferred choice for the Myanmar community, targeting no less than 150,000 active users and a transaction value exceeding 2 billion baht by the close of 2024.

A survey conducted by DeeMoney in February 2023 revealed that more than 94% of Myanmar workers typically transferred money to their home country through informal channels such as money transfer agents (Hundi), while a few chose to transport the money themselves or via acquaintances. Merely a small percentage utilized formal banking channels for money transfers. This trend is attributed to the limited access most users have to financial services (being ‘Unbanked’). Moreover, the exchange rates within the conventional financial system are notably higher compared to the rates offered by informal services (Hundi).

The outcomes of this survey prompted the collaborative effort between DeeMoney and SCB to directly manage the exchange rates between the Thai baht and the Myanmar kyat. Consequently, DeeMoney has emerged as one of the key service providers offering the most competitive exchange rates for money transfers from Thailand to Myanmar. Importantly, this collaboration has obtained authorization from the central banks of both countries, namely the Bank of Thailand and the Central Bank of Myanmar.

Regarding destination countries, DeeMoney is steadfast in its commitment to expanding its network coverage extensively, enabling customers to transfer funds to prominent bank accounts in Myanmar, including institutions such as A Bank, Aya Bank, CB Bank, KBZ Bank, Yoma Bank, and more than 20 other banks. Bangkok Police Arrest Chinese Man Who Raped American Woman

Police officers questioned a Chinese man, 25, a suspect, on charges of forcibly sexually assaulting another person.

Three days after an American woman reported she had been raped in her residence in Bangkok, Thailand, police officers from Huai Khwang Police Station arrested Mr. He Tianming, a 25-year-old Chinese national, on charges of forcibly sexually assaulting another person.

The Chinese man was arrested at a residence on Ratchadaphisek Road, Huai Khwang District, Bangkok on November 7.

This case stems from an incident that took place on 4 November. At the time, a 24-year-old American woman reported that she had been attacked by a man, known only by his nickname “Tim”, via the dating app Tinder.

The two had met in a bar in the middle of the night on November 2. At 2:00 am on 3 November, the man became violent in her room, even though she had previously agreed not to engage in sexual activity. 

She reiterated her intention to take legal action, while the man admitted to arranging the meeting via the app for sexual intercourse, which the woman had not consented to. The police will continue the prosecution.

The English Court’s Ruling In “Nop Narongdej” Case Has No Valid in Thailand

Nop Narongdej’s lawyers issued a press release explaining the latest developments in the Wind Energy Holding (WEH) stock case. They confirm that the Thai court has ruled the sale of WEH shares by REC to Khunying Korkaew “not deemed defrauding creditors,” and the English court’s ruling to punish Mr. Nop Narongdej and several other defendants is not valid in Thailand.

The press release stated that before Mr. Nopporn Suppipat’s companies filed the WEH shares-related case in the English court, specifically the Business and Property Courts of England and Wales (Commercial Court), Mr. Nopporn’s companies already filed a “criminal case” in the Thai court, specifically the South Bangkok Municipal Court, on January 23, 2018, on the matter of “cheating against creditors.”

They requested the court to punish Mr. Nop Narongdej, and several other defendants according to the Thai Penal Code, alleging that the transfer of WEH shares held by REC to Khunying Korkaew was done with “special intent” to prevent Mr. Nopporn’s companies from collecting debt from Mr. Nop’s companies, which were the shareholders of REC.

At the time Mr. Nopporn’s companies filed the case in the English court, the Thai court had not yet made a judgment.

Mr. Nopporn’s companies filed the case in the English court six months later, on August 7, 2018, as a “civil case” to claim damages from Mr. Nop’s group, adding three more defendants from the Thai court case: Siam Commercial Bank (SCB), Mr. Arthid Nanthawithaya, and Mr. Weerawong Chittmittrapap as defendants, alleging that all defendants jointly committed a “wrongful act” according to the Thai Civil and Commercial Code.

This involved the defendants jointly and intentionally “committing an offense” against Mr. Nopporn’s companies, thereby causing damage to Mr. Nopporn’s group. The alleged “commission of the offense” was characterized as “defrauding creditors” according to the Thai Penal Code.

This was because REC transferred the held WEH shares to Khunying Korkaew with “special intent” to prevent Mr. Nopporn’s companies from collecting debt from Mr. Nop’s companies, the shareholders of REC. This was the same fact that Mr. Nopporn’s companies had previously filed a “criminal case” in the Thai court.

The English court would have to apply “Thai law”, which is the law of the country where the “wrongful act” occurred, in making its judgment.

The English court made its ruling on 31 July 2023, dismissing the case against Siam Commercial Bank (SCB) and Mr. Arthid, but ordering all the remaining defendants to jointly pay a substantial amount of money to Mr. Nopporn’s companies.

The English court ruled that there was “defrauding creditors” according to the Thai Penal Code, which constituted a joint act of “wrongful act” by the defendants according to the Thai Civil and Commercial Code.

However, on October 31, the South Bangkok Municipal Court made a “dismissal” judgment for Khunying Korkaew, Mr. Nop, and all the other defendants, stating that they did not commit “defrauding creditors,” which effectively completely reversed the judgment of the English court. Therefore, the past judgment of the English court no longer holds any validity for anyone to claim for any purpose in Thailand.

The South Bangkok Municipal Court has ruled that the sale of shares in Wind Energy Limited by REC is “not considered as defrauding creditors” since there was no “special intent” to cause Mr. Nopporn’s companies to not receive debt repayment from Mr. Nop’s companies, an element of the offense of “defrauding creditors.” “Because it was an action taken out of necessity and was a consequence of Mr. Nopporn’s own defective qualities… which caused significant investment obstacles for Wind Energy Limited, which are considered factors in business operations. Should these not be re-structured, they would inevitably damage the value of already invested assets, including the value of the business that must be continued in the future, which the damage… would also cause harm to other investors involved in the business.” That is, the act was done out of necessity arising from Mr. Nopporn.

Furthermore, the South Bangkok Municipal Court also ruled that in the evidence provided by Mr. Nopporn’s group, “no mention was made of the fact that Mr. Nopporn, who was the executive with control over the original operations of Wind Energy Limited, was accused of committing offenses … under the Penal Code, Section 112, which was a major cause of operational problems for the Wind Energy Limited group since late 2014. The presentation of evidence by Mr. Nopporn’s group was evasive by not revealing the detrimental facts about Mr. Nopporn, who was the former top executive of the Wind Energy Limited group, implying concealment of facts which were the cause of the problems created by Mr. Nopporn himself and resulted in the business facing obstacles and losing credibility among investors and financial institutions that would support investment funding. Especially that fact caused Siam Commercial Bank not to approve the drawdown of the loan that Watabak Limited, which is part of the Wind Energy Limited group, urgently needed for business operations.”

Mr. Weerawong Chittmittrapap, a legal advisor, said that the decision by an English judge that the defendants conspired to “defraud the creditors” stems from a refusal to consider evidence presented by witnesses who have no “motive” that would make them unreliable. Mr. Weerawong insisted that he had no other interest or “motive” that would necessitate giving advice to the client that would lead to an illegal act. All these facts were presented in the case and were well acknowledged by the English judge.

BANGKOK — Thailand’s government has photographs of Thai workers who are being held hostage in Gaza by Hamas following its October 7 attack on Israel, showing they are alive, the prime minister said Monday.

Prime Minister Srettha Thavisin did not say how many hostages the photos showed. The Thai government’s official number of “abductions” is 24. Thirty-four Thais are known to have been killed and 19 injured.

“There is an update that there are photos of the hostages. So, we understand that at least they are still alive. The negotiation efforts are still ongoing,” Srettha told reporters.

Thailand is pursuing several channels to obtain the release of the hostages, including a trip last week by Foreign Minister Parnpree Bahiddha-Nukara to Egypt and Qatar.

Almost 8,000 Thai workers have returned home from Israel out of a pre-attack total of around 30,000. Most are employed as semi-skilled farm laborers who come from poorer regions of Thailand and are able to earn a much better income by working abroad.

DEIR AL-BALAH, Gaza Strip (AP) — Israeli forces severed North Gaza from the rest of the besieged territory and pounded it with intense airstrikes overnight into Monday, setting the stage for an expected push into the dense confines of Gaza City and an even bloodier phase of the month-old war.

Already, the Palestinian death toll passed 10,000, the Health Ministry in Hamas-run Gaza said Monday. The ministry does not distinguish between fighters and civilians. Some 1,400 Israelis have died, mostly civilians killed in the Oct. 7 incursion by Hamas that started the war.

The figures mark a grim milestone in what has quickly become the deadliest round of Israeli-Palestinian violence since Israel’s establishment 75 years ago, with no end in sight as Israel vows to remove Hamas from power and crush its military capabilities.

Casualties are only likely to rise as the war turns to close urban combat. Troops are expected to enter Gaza City soon, Israeli media reported, and Palestinian militants who have had years to prepare are likely to fight street by street, launching ambushes from a vast network of tunnels.

“We’re closing in on them,” said Lt. Col. Richard Hecht, an Israeli military spokesman. “We’ve completed our encirclement, separating Hamas strongholds in the north from the south.”

The military said it struck 450 targets overnight and ground troops took over a Hamas compound. A one-way corridor for residents to flee south remains available for the hundreds of thousands of Palestinians who remain in Gaza City and other parts of the north, according to the military.

Some 1.5 million Palestinians, or around 70% of Gaza’s population, have fled their homes since the war began. Food, medicine, fuel and water are running low, and U.N.-run schools-turned-shelters are beyond capacity. Many people are sleeping on the streets outside.

Mobile phone and internet service went down overnight, the third territory-wide outage since the start of the war, but was gradually restored on Monday. Aid workers say the outages make it even harder for civilians to seek safety or call ambulances.

Israel has so far rejected U.S. suggestions for a pause in fighting to facilitate humanitarian aid deliveries and the release of some of the estimated 240 hostages seized by Hamas in its raid. Israel has also dismissed calls for a broader cease-fire from increasingly alarmed Arab countries — including Jordan and Egypt, which made peace with it decades ago.

After days of intense diplomacy around the Middle East, U.S. Secretary of State Antony Blinken wrapped up his tour of the region on Monday, saying efforts to secure a humanitarian pause, negotiate the release of hostages and plan for a post-Hamas Gaza were still “a work in progress” without pointing to any concrete achievements.

The war has also stoked wider tensions, with Israel and Lebanon’s Hezbollah militant group trading fire along the border. In another sign of growing unrest, a Palestinian man stabbed and wounded two members of Israel’s paramilitary Border Police in east Jerusalem before being shot dead, according to police and an Associated Press reporter at the scene.

Israel captured east Jerusalem, along with Gaza and the West Bank, in the 1967 Mideast war. The Palestinians want all three territories for a future state. Israel annexed east Jerusalem in a move not recognized by most of the international community and considers the entire city its capital.

In northern Gaza, a Jordanian military cargo plane air-dropped medical aid to a field hospital, King Abdullah II said early Monday. It appeared to be the first such airdrop of the war, raising the possibility of another avenue for aid delivery besides Egypt’s Rafah crossing, which has so far been the only entry point.

Over 450 trucks carrying aid have been allowed to enter Gaza from Egypt since Oct. 21. But humanitarian workers say the aid that has come through the Rafah crossing is insufficient to meet mounting needs in the territory, which is home to some 2.3 million Palestinians.

The crossing was closed on Saturday and Sunday because of a dispute among Israel, Egypt and Hamas. But it reopened Monday for the evacuation of patients and foreign passport holders, according to Wael Abu Omar, a spokesman for the Palestinian Crossings Authority.

Northern Gaza is facing a severe water shortage, as there is no fuel to pump from municipal wells and Israel shut off the region’s main line. The U.N. office for humanitarian affairs said seven water facilities across Gaza were struck over the last two days and sustained “major damage,” raising the risk of sewage flooding. Israel has restored two water pipelines in central and southern Gaza, the U.N. said.

Some 800,000 people have heeded Israeli military orders to flee to southern Gaza. Some 2,000 people, many carrying only what they could hold in their arms, walked down Gaza’s main north-south highway on Sunday. “The children saw tanks for the first time. Oh world, have mercy on us,” said one Palestinian man, who declined to give his name.

But Israeli bombardments have continued across the territory, and strikes in central and southern Gaza — the purported safe zone — killed dozens of people on Sunday. Israel blames civilian casualties on Hamas, accusing the militants of operating in residential neighborhoods.

After another strike Monday, in the southern town of Khan Younis, men dug through the rubble with sledgehammers and their bare hands. A young boy caked in dust screamed as he was rolled onto a stretcher and carried away. At least two people were killed, according to an AP reporter at the scene.

Earlier Monday, Palestinians held a mass funeral for 66 people outside a hospital in the central town of Deir al-Balah. The bodies were wrapped in white sheets on the ground outside the hospital morgue. A man with bandages wrapped around his head placed his hand on a child’s body and wept.

The Health Ministry said that 10,022 people have been killed in Gaza, including over 4,100 children and 2,600 women.

Meanwhile, four civilians were killed by an Israeli airstrike on a vehicle in south Lebanon late Sunday, including three children, a local civil defense official and state-run media reported. The Israeli military said it was reviewing the strike, after initially saying it had struck Hezbollah targets following anti-tank fire that killed an Israeli civilian. Hezbollah said it fired Grad rockets into Israel in response.

In the overnight strikes in Gaza, the Israeli military said it had killed a senior Hamas militant, identified as Jamal Mussa, who had allegedly carried out a shooting attack against Israeli soldiers in Gaza in 1993.

It said 30 Israeli troops have been killed since the ground offensive began over a week ago. Hamas and other militants have continued firing rockets into Israel, disrupting daily life even as most are intercepted or fall in open areas. Tens of thousands of Israelis have evacuated from communities near the volatile borders with Gaza and Lebanon.

Thai Smile, a domestic subsidiary of Thai Airways established in 2011, will cease operations and transfer all its activities and staff to an internal company in January 2024.

Chai Eiam-siri, the CEO of Thai Airways, announced the restructuring plan. Currently, 20 Airbus A320s are being taken over from Thai Smile, which were mainly used on domestic and international short-haul routes. There are also plans to bring Thai Smile’s employees under the Thai Airways umbrella. This transition is expected to be completed by January 2024.

So far, 4 aircraft have already been handed over. The process of returning 20 aircraft to Thai Airway begins with the airline notifying the Civil Aviation Authority of Thailand (CAAT) and the Ministry of Transport.

Once the 20 aircraft have been returned, the Air Operator’s Licence (AOL) must be cancelled. This measure will lead to the end of the WE Airline Code for Thai Smile. In addition, Thai Smile’s licence will expire in January 2024.

This change will reduce Thai Airways’ average daily aircraft utilisation from 12-13 hours to 11 hours per day, which is still higher than Thai Smile’s average of 9 hours per day. This change is expected to reduce Thai Airways’ hourly operating costs by approximately 20 percent.

Mr Chai mentioned that the employees of Thai Smile will have to work under Thai Airways. Thai Smile’s pilots and crew will continue to use Airbus A320 aircraft and operate both domestic and international routes under the airline’s TG code. Thai Airways will expand its service on all routes previously operated by Thai Smile.

As far as the name “Thai Smile Airways” is concerned, it is currently assumed that it will remain registered as an independent company. Thai Airways sees opportunities to utilize Thai Smile for other aviation related businesses.
